First, your international student adviser, should have notified you that your I-20 was about to expire. This is what USCIS requires them to do. Actually the SEVIS system automatically notifies IS advisers about I-20 expiring. Now, having said that, no, you cannot work. You need to apply for reinstatement and wait until it gets approved. Reinstatement into F-1 are very difficult as you need to show that you fell out of status because of circumstances beyond your control. You will probably need to argue that your adviser had failed to notify you and that you kept attending school and it was only a few days of out of status.

"Is it usual for big employers to already have H1 visas to sponser you on".. All I know is that employers cannot have blank visas for hiring whom they want. They have to file a new application for a specific employee, so they have to start from scratch.
If your F1 covers you for 2.5 years, then there's some hope that immigration laws will change during this time. Because right now it's a nightmare. If nothing changes in the laws and cap number stays at ~65,000, then you will have to win a lottery to get an H1. We'll see on April 1, but most likely there is also a lottery for Master's degree holders.

I have 140 approval notice in mail like 1.5yrs back...just today i put the reciept number on USCIS website and it says still pending..i called USCIS and they say they wont be able to discuss my case since 140 is employer specific only....my employer is sayin dont worry and dont bother about online status...i just want to make sure my 140 is really approved and USCIS has the correct update while lookin at my 485 file...i dont want them to put my 485 in hold just because of they thinkin 140 is not approved...

My husband's employer filed for green card under EB-1 (OR). I-140 got approved, I-485 is pending. I already did my fingerprinting. My husband's is scheduled for next week. We did not get EAD or AP yet.
Meanwhile I need to travel to Europe on business. I have a valid H-1 to re-enter US. Would my AP get approved before I return to US? If so, can I still enter with my valid H-1? My husband is planning to delay his biometrics until I get back. Are there any problems with this plan? Please advise

As long as the water is all of the same temp and salinity there isn't any distortion because of water movement. Distortion does occur when you get mixing of water that has different density. Scuba diving you see that where you pass through layers of water on the way down. The layers can be either different temerature or different salinity. When you get that it looks like heat waves on a hot highway in the distance.
I have used the pentax optio under water a bit. It works well as a point and shoot but not much more than that. I wouldn't take it more than a few feet down. I don't think it is rated for very deep.

Once your H1b application gets selected you cannot work until atleast oct 01 2009 which is usually start date on the approval. the date may not be exactly oct 01 but it will be certainly in that range.

Nothing! This bill passed the Senate a month before they started the CIR. Cornyn introduced the SKIL act and then he immediately withdrew it because he was hoping that it will become part of the future Immigration bill. Later on the CIR failed and we are left with nothing again.

I applied for Labor in EB2 category in Oct 2007. It was pending for 2 yrs and 2 days back my employer mentioned that they see my Labor status as denied and that they have not received any denial letter yet.
My H1 will expire in early Jan 2011, so I practically have around 365 days from now to apply for a new Labor. My questions are
1. Should I re-appeal?
2. Do Labors get approved in re-appeal?
3. Can I start a new Labor application with the same employer simultaneously?
4. What�s a safe category to apply at this point in time. EB2 or EB3?

As far as I recollect, the Murthy article was about the spouse(dependent) receiving a GC (as part of a derivative spousal application) when his/her spouse(primary beneficiary)'s PD or her PD was not yet current.
Primary beneficiary had not received the GC, but spouse received it in error. May be that's diff from the situation where the primary beneficiary himself/herself receives the GC while the PD is not current.

Guys,
I applied for Advance parole in 1st week of August. I called to expedite it on 2nd sept (due to family emergency) and they responded back to my request saying they had already approved my application on 1st Sept and mailed me a notice. Since I didn't receive it even after 3 weeks, I was sure my approval notice got lost in mail so I applied again (since I had to leave to India immediately because of the family emergency) and 2nd application reached them on 22nd sept and on 28th I received a receipt notice for the second application. On 24th sept I got an email saying my first AP application was approved and I received that notice on Oct 1st. Now my second application is pending and I have to leave latest by this Thursday. People are saying I can write a letter to TSC asking to withdraw my second application and they will just withdraw it. But now is it safe to travel before I hear something about my second application? Anyone been in this situation before? pls advice.

If your wife wants to transfer to a cap-subject employer, she will only be able to do so if the H-1 quota for the fiscal year has not been used up. If the H-1 cap has not been reached then transferring from a cap-exempt employer is no more difficult than transferring from a cap-subject employer. (though the new start date would have to be Oct. 1 or later)

I am a resident of the Chennai Consular District and I made an emergency appointment (returning US worker-H visa) for my H-1 renewal visa at New Delhi through the vfs website. I was not able to find any appointments at the Chennai consulate. I happened to know today through the New Delhi Embassy website that their emergency appointments are reserved only for residents of the New Delhi Consular District. I'm confused as to how/why the vfs website allowed me to make an appointment without providing this information. I am now unable to find any regular appointments available at New Delhi or emergency appointments at Chennai.
Also, the vfs website has a news update from Dec.4th stating that anyone (fluent in english) can now apply at New Delhi, Chennai or Mumbai. I do not know if this precludes the emergency appointment requirement at New Delhi as stated above or if this is a more up to date info.
If anyone here has any information/experience about this, I would appreciate a response.

I got the same kind of RFE , but the wage paid to me is much more than the proferred wage all along . But USCIS wants my company to prove that they have the ability to pay all the pending 140s .. Do you guys think I am Safe?
