    Helllo Experts,

    Here is my Case:

    Have 4 yrs of work experience and changed 3 employers in the past.

    1 st employer: Worked as a Programmer Analyst for 6 months
    2nd employer: Worked as Sr.Software Engineer for1.6 years
    3rd Employer: Worked as Sr.Software Engineer for 2 years

    Under unexpected circumstances, 2nd employer filed my H1 for a senior level even when I have only 2.5 yrs of experience.

    I am trying to change job and look for a prospective employer who would file my labor/GC immediately.

    The 4rth employer is willing to my GC but the Job designation will be Software Engineer.

    Can you please advise if there would be any negative impact on my GC process if I take a step down in my title.

    I liked the organization, work environment and all I am concerned now is about any RFC's for the different Job Titles I had so far.

    I am in a very confused state and Please advise me as I need to respond for the Job offer.

    Has anyone requested premium processing of I-140 based on expiry of the sixth year of H1B. My 6th year H1B expires next month and I think I am eligible for premium processing.

    You are eligible only if there is *no* other way of extending your H1-B. If your labor certificate is more than 1 year old, then you are not eligible. In that case you can get 1 year extension based on the LC.

    Nah you are right, that is all I did, but I honestly doubt anyone would make a fuss :) I mainly made them for the sake of it, the only ones I'd definately want to see on there are the first 2 anyway so you can take the others off if ya don't want them :)

    This was the first time I called up the USCIS help desk (1-800-375-5283) to find about AC21 180 days rule, when she asked what is this for I informed for change of employer.
    I would like to know if that statement would be noted and would it create me any problems in future, as of now I don�t have any plans to change employer.
    Any suggestions are greatly appreciated.

    My Case Details:
    PD: EB2- 2006.
    I-140 Cleared.
    EAD: Received.
    FP: Completed

    Yes, they would record your call but I dont see it creating any problems in the future as long as you satisfy the AC21 conditions if/when you change jobs.

    You should join your state chapter through the IV forums. State Chapter volunteers should plan to contact local politicians and meet them face to face. Nothing is more powerful than visiting face to face and impressing upon politicians how important this issue is.

    My wife and I are scheduled to go for fingerprinting this month. We have a year old son and obviously we are planning to take him with us as well. Do I need to take any form of ID / birth certificate of my son (obviously he is not to be fingerprinted) but not sure what the rules are with respect to carrying infants for the interview. Anyone who has fingerprinted in a similar situation?

    Hi,

    A friend of mine who's in India right now has been offered a job by two different employers here in the US. Both of those employers want to file for her H1B.
    From her perspective it makes sense to let both the employers apply for her H1 coz that increases her chances of getting at least one approved. However, reading a bunch of FAQs online it seems that it'd be illegal for her to let both the employers apply for her H1B.
    Is that correct? Does anyone have any insights?

    1. Will your company keep your 140 alive? Meaning, will they withdraw it - I know a lot has been said about 140 PD being yours once approved and blah blah, but no one seems to report that they have successfully ported their 140 date to a new 140 application. This is strange but true. So I will make it doubly sure with my company.

    2. Uscis might ask why your company is sponsoring two 140s for the same individual - your company should be prepared to answer that. This is exactly why my company refuses to reapply for the GC process for the same individual (it really raises a question of intent). Again, can be done, but needs full support from company


    Rest should be ok.

    Okay, on a more relevant note to your request...

    I can't substantiate the numbers, but I am sure that we contribute more volunteer hours per capita due to our spouses not being able to work.

    Lower crime rate per capita due to fear of deportation.

    I am currently on H1b and I have applied for an extension around July 14th. My i-94 is expiring on
    Sept 20th. My husband is currently on F-1. I wanted to find out in case my H1b visa is rejected, will
    I have to immediately leave the country. Would it be possible for me to convert to F-2 while being in US
    in case my H1-B gets rejected?

    Convert H1 into Premium. You need to get the results before Sept-20. So that you can apply for F2 visa.

    Hello everybody,
    My lawyer mailed me photocopy of I-485 form ,EAD application and AP form
    which she filed last month. I saw that my lawyer has enter my old address (Michigen ) by mistake. My current address is in Illinois. The G328 form mentions the Illinois address as my present address. I had already send my AR-11 mentioning my Illinois address as my new address before my I-485 was filed.
    My worry is will the finger print notice,EAD, will come to Michigen address or Illinois address

    Pls guide what should I do to change the address on 485 to my new address..

    My 485 application was recieved by R.Cook@NSC too and no receipts or checks cashed yet. My application was delivered on July 18'th. My I-140 was approved on May 11'th 2007 by TSC.

    My H1B 6 yr limit is set to expire in July 2008. I have an EAD/AP from filing in July. I want to invoke AC21 and change jobs using EAD. I hear a lot of people mention about keeping your H1B visa just in case the I-485 application gets rejected. But even if I extend my H1, it will be based on the fact that I have applied for I-485 since I am over the 6 yr limit. In that case, won't my H1 extension be void too if the I-485 gets rejected. I am not really sure how maintaining H1B/EAD together helps people in my situation. ANy thoughts/inputs welcome.

    You extend you H-1B (< 6yrs) based on approved PERM and/or approved I-140. So if your I-485 was rejected, your H-1B would be safe. However, if your employee or USCIS revoked the approved PERM/I-140, then I don't know what would happen to the extended H-1B.

    If you invoked EAD and USCIS rejected your I-485, you would lose the EAD as well as the I-485 pending status because EAD was granted on your pending I-485 status.
